Terms & Conditions of Use

The rules of the service. What we offer, what you can expect from us, what is expected of you, and where the legal limits are. Read them before using the site or the API.

1. Acceptance of the terms

By accessing and using the site gestionpublicaperu.com.pe, the public API, the MCP server, the public product pages (Rankings, SSI, Daily Analysis), or the private platform (app.gestionpublicaperu.com.pe), you declare that you know and accept these Terms & Conditions of Use, as well as the Privacy Policy.

If you do not agree with any of the terms, we ask that you stop using the service.

3. Services covered by these terms

These terms govern the use of all services operated by Gestión Pública Perú E.I.R.L., including — but not limited to —:

  • The public site gestionpublicaperu.com.pe and its pages.
  • The public REST API for MEF Insights (/api/insights/*).
  • The MCP (Model Context Protocol) server for AI clients.
  • The Sectoral and Regional Rankings of public investment.
  • The SSI Dashboards of public investment projects.
  • The Daily Public Spending Analysis published on LinkedIn.
  • Consolidated downloads and reports (HTML, PDF, PowerPoint, .pbix, .pq).
  • The private platform app.gestionpublicaperu.com.pe for contracted clients.

4. Nature of the information presented

⚠️ Important — Gestión Pública Perú is NOT an official MEF site.

The budget and public-investment information we display comes from Open Data of the Ministry of Economy and Finance (MEF) and its public portals (apps5.mineco.gob.pe, datosabiertos.gob.pe, Invierte.pe, SEACE, Infobras). We process, aggregate, normalize, and visualize this data for analytical and educational purposes.

For critical uses — judicial, tax, contractual decisions, or any matter requiring official evidentiary value — the user must always consult the official MEF sources.

Information is provided "as is", in the state it is in at the time of consultation, without warranty of absolute accuracy, completeness, or uninterrupted availability.

5. Intellectual property

  • Gestión Pública Perú E.I.R.L.'s own software (including platform, frontend, backend, ETL scripts, and orchestration processes) is the intellectual property of the company and is protected by the copyright laws in force in Peru and applicable international treaties.
  • The original budget data comes from official sources of the Peruvian State (MEF) and is in the public domain, pursuant to Law No. 27806 on Transparency and Access to Public Information.
  • The visualizations, aggregations, dashboards, computed metrics, and analytical narratives we produce over that data are derivative works and are protected as such.
  • The marks "Gestión Pública Perú", "GPP", "GPP DATA" and the "G" monogram are distinctive signs of the company.

6. License to use public data

Any person or organization may freely use the data accessible through the public products (Rankings, SSI, REST API, MCP, Daily Analysis) for academic research, investigative journalism, citizen analysis, and civil-society work, subject to the following conditions:

  • Attribution required. Any publication, note, or report built with this data must attribute the source as "Gestión Pública Perú — gestionpublicaperu.com.pe" with a link to the site where the medium allows.
  • No service interference. You may consume the API within the established rate limit (30 queries per minute per IP). Aggressive scraping of the site, limit evasion, or bypassing technical mechanisms is prohibited.
  • No defamatory use. Do not use the data to defame individuals, entities, or public officials, nor for purposes contrary to Peruvian law.
  • Acknowledgment of the underlying source. Where relevant, also cite the MEF as the original source of the primary data.

7. Expected user conduct

When using our services, you agree not to engage in the following conduct:

  • Aggressive scraping that affects service availability.
  • Evasion of the API rate limit via IP rotation, proxies, etc.
  • Unauthorized access attempts to the private platform or to profiles that do not belong to you.
  • Reverse engineering, decompilation, or unauthorized modification of the software.
  • Injection of malicious code (SQL injection, XSS, etc.) or exploitation of vulnerabilities.
  • Use of the service for illicit activities under applicable Peruvian or international law.
  • Identity impersonation or use of third-party credentials without consent.

If you discover a security vulnerability, we ask that you report it responsibly to soporte@gestionpublicaperu.com.pe before disclosing it. We appreciate ethical disclosure.

8. Limitation of liability

To the maximum extent permitted by Peruvian law:

  • The service is provided "as is" and "as available", without implied warranty of accuracy, completeness, or fitness for a particular purpose.
  • Gestión Pública Perú E.I.R.L. shall not be liable for indirect damages, lost profits, data loss, or business decisions made on the basis of the information presented.
  • The user acknowledges that budget information may be subject to later updates or corrections by the MEF, so it is recommended to cross-check with official sources before critical decisions.
  • We do not guarantee uninterrupted service availability. Planned or unplanned interruptions may occur due to maintenance, third-party infrastructure failures (Cloudflare, MEF, etc.), or any other cause.

For clients with a current contract, the liability limitations agreed in the specific contract prevail over the general ones set out here.

9. Contracted services (B2G)

For public entities that contract the private services of Gestión Pública Perú E.I.R.L. (access to app.gestionpublicaperu.com.pe, consulting, custom automation, support, etc.), the terms of the specific contract signed between the entity and Gestión Pública Perú E.I.R.L. prevail over these general terms in case of conflict.

These general terms apply on a subsidiary basis to anything not expressly governed by the signed contract.

10. Changes to these terms

We may amend these terms at any time. If the changes are substantial, we will give you at least 15 days' notice via a visible notification on the site. Continued use of the service after the effective date of the changes implies acceptance of the new terms.

11. Suspension and termination of access

We reserve the right to suspend or restrict access to any user who:

  • Violates these terms.
  • Makes abusive use of the service that affects availability for other users.
  • Engages in conduct prohibited under section 7.
  • By order of a competent authority.

For contracted clients, termination of access is governed by the clauses of the signed contract.

12. Governing law and jurisdiction

These Terms & Conditions are governed by the laws of the Republic of Peru. Any dispute arising from their interpretation, performance, or application shall be subject to the courts of the judicial district of Lima, the parties waiving any other jurisdiction.
